Here\u2019s How VoteRiders Is Protecting Our Democracy."},"content":{"rendered":"<p><b>By <a href=\"https:\/\/www.voteriders.org\/team\/ceridwen-cherry\/\" target=\"_blank\" rel=\"noopener\">Ceridwen Cherry<\/a>, VoteRiders Legal Director \u2014 <\/b><b>June 28, 2023<\/b><\/p>\n<p><a href=\"https:\/\/www.voteriders.org\/team\/ceridwen-cherry\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">As VoteRiders\u2019 new Legal Director<\/span><\/a><span style=\"font-weight: 400;\">, I\u2019m tasked with monitoring changes to <\/span><a href=\"http:\/\/voteriders.org\/idcheck\"><span style=\"font-weight: 400;\">voter ID laws in states <\/span><\/a><span style=\"font-weight: 400;\">around the country so that we can provide continuously updated and accurate information to voters and our thousands of partner organizations.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Here\u2019s the bad news: I\u2019ve been really busy lately! Since 2020 and especially in 2023 so far, states have passed new or stricter <a href=\"https:\/\/www.voteriders.org\/voterid\/\" target=\"_blank\" rel=\"noopener\">voter ID laws<\/a> at unprecedented rates. <\/span><\/p>\n<blockquote><p><strong>These laws could prevent millions of eligible voters from casting their ballots and making their voices heard in elections this year and beyond.\u00a0\u00a0<\/strong><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">This month marks the ten-year anniversary of the Supreme Court\u2019s decision in <\/span><i><span style=\"font-weight: 400;\">Shelby County v. Holder<\/span><\/i><span style=\"font-weight: 400;\">. Before <\/span><i><span style=\"font-weight: 400;\">Shelby, <\/span><\/i><span style=\"font-weight: 400;\">nine mostly-Southern states had to notify the U.S. Department of Justice if they planned to make any changes to their voting laws because of their prior history of racial discrimination (\u201cpre-clearance\u201d).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2013, the <\/span><i><span style=\"font-weight: 400;\">Shelby <\/span><\/i><span style=\"font-weight: 400;\">ruling <\/span><span style=\"font-weight: 400;\">struck down the pre-clearance protections previously afforded by Section 5 of the Voting Rights Act. As a result, <\/span><span style=\"font-weight: 400;\">states became able to change voting laws and policies without the pre-clearance that was previously required.<\/span><span style=\"font-weight: 400;\"> We saw the immediate consequences of this ruling when, in the lead up to and immediate aftermath of the <\/span><i><span style=\"font-weight: 400;\">Shelby<\/span><\/i><span style=\"font-weight: 400;\"> decision, five states previously covered by Section 5 enacted strict voter ID laws.\u00a0<\/span><\/p>\n<blockquote><p><strong>In the decade since <i>Shelby<\/i>, I\u2019ve dedicated my career to challenging restrictive voting laws because I believe our democracy is strongest when everyone can have a say in the decisions that impact and shape their future. <\/strong><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">I have <\/span><span style=\"font-weight: 400;\">extensive experience litigating voting rights cases throughout the country, including challenges to voter identification and voter registration requirements. During this time,<\/span><span style=\"font-weight: 400;\"> I\u2019ve seen voting restrictions of all types proliferate, especially the expansion and tightening of voter ID laws.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><a href=\"https:\/\/www.voteriders.org\/about\/\" target=\"_blank\" rel=\"noopener\">VoteRiders was founded in 2012<\/a>, just before <\/span><i><span style=\"font-weight: 400;\">Shelby. <\/span><\/i><span style=\"font-weight: 400;\">In the 11+ years since our founding, the need for our work has grown enormously. <\/span><\/p>\n<blockquote><p><strong>In fact, today in 2023, 52 million <i>more<\/i> Americans live in a state with a voter ID law than in 2012. These complicated laws disenfranchise millions of voters who lack ID and deter even more voters from participating in elections due to confusion.\u00a0<\/strong><\/p>\n<p>&nbsp;<\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-16282\" src=\"https:\/\/www.voteriders.org\/wp-content\/uploads\/2023\/06\/2012_TW-300x158.png\" alt=\"2012 states with voter ID laws \" width=\"700\" height=\"368\" srcset=\"https:\/\/www.voteriders.org\/wp-content\/uploads\/2023\/06\/2012_TW-300x158.png 300w, https:\/\/www.voteriders.org\/wp-content\/uploads\/2023\/06\/2012_TW-1024x538.png 1024w, https:\/\/www.voteriders.org\/wp-content\/uploads\/2023\/06\/2012_TW-768x403.png 768w, https:\/\/www.voteriders.org\/wp-content\/uploads\/2023\/06\/2012_TW.png 1200w\" sizes=\"auto, (max-width: 700px) 100vw, 700px\" \/><\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-16284\" src=\"https:\/\/www.voteriders.org\/wp-content\/uploads\/2023\/06\/2023_TW-300x158.png\" alt=\"2023 states with voter ID \" width=\"700\" height=\"368\" \/><\/p>\n<p>I started this post with some bad news, but here\u2019s the good news: I\u2019m excited to be part of the <a href=\"https:\/\/www.voteriders.org\/team\/\" target=\"_blank\" rel=\"noopener\">quickly-growing team at VoteRiders<\/a> that is dedicated to helping voters cast a ballot despite the rising tide of voter ID laws.<\/p>\n<p><span style=\"font-weight: 400;\">In my first months with the organization, I\u2019ve seen how we\u2019re poised to make a real difference at a time when our work is more important than ever.\u00a0<\/span><\/p>\n<blockquote><p><strong>An estimated <a href=\"https:\/\/www.voteriders.org\/analysis-millions-lack-voter-id\/\" target=\"_blank\" rel=\"noopener\">25 million voting-age Americans do not have a current government-issued photo ID<\/a>. <a href=\"https:\/\/www.voteriders.org\/mission\/\" target=\"_blank\" rel=\"noopener\">Voter ID laws disproportionately impact communities<\/a> that are already underrepresented in our electorate: people of color, <a href=\"https:\/\/www.voteriders.org\/student\/\" target=\"_blank\" rel=\"noopener\">young adults<\/a>, voters with disabilities, older Americans who no longer drive, unhoused individuals, <a href=\"https:\/\/www.voteriders.org\/willie-ohio-voter-story\/\" target=\"_blank\" rel=\"noopener\">returning citizens<\/a>, low-income Americans, and voters such as married women or <a href=\"https:\/\/www.voteriders.org\/pride\/\" target=\"_blank\" rel=\"noopener\">transgender individuals<\/a> who change their names.\u00a0<\/strong><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">The first months of 2023 were no exception to this pattern of increasing voter ID laws. <\/span>In the first seven months of this year alone, <strong>new or stricter voter ID laws were adopted or went into effect in eight states:<\/strong><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.voteriders.org\/states\/arizona\/\" target=\"_blank\" rel=\"noopener\"><b>Arizona<\/b><\/a><span style=\"font-weight: 400;\"> now requires election officials to investigate the citizenship status of voters who use the federal voter registration application form without providing documentary proof of citizenship.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.voteriders.org\/states\/idaho\/\" target=\"_blank\" rel=\"noopener\"><b>Idaho <\/b><\/a><span style=\"font-weight: 400;\">removed student IDs as an accepted form of voter ID in the wake of record-breaking youth voter registration across the nation, effective January 1, 2024. Idaho also added a photo ID requirement for new voter registrations.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.voteriders.org\/states\/indiana\/\" target=\"_blank\" rel=\"noopener\"><b>Indiana<\/b><\/a><span style=\"font-weight: 400;\"> now requires those voting by mail-in ballot to submit ID or identifying information with an absentee ballot application.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.voteriders.org\/states\/nebraska\/\" target=\"_blank\" rel=\"noopener\"><b>Nebraska<\/b><\/a><span style=\"font-weight: 400;\"> became the tenth state in the country to adopt a strict photo ID law. Under this law, voters must show a photo ID to vote in Nebraska in person or by mail unless you meet one of three exceptions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.voteriders.org\/states\/new-hampshire\/\" target=\"_blank\" rel=\"noopener\"><b>New Hampshire<\/b><\/a><span style=\"font-weight: 400;\"> now requires that <\/span><span style=\"font-weight: 400;\">in-person voters who are registering for the first time and who are unable to prove their identity cast an \u201caffidavit ballot\u201d on Election Day. This ballot is only counted if the voter submits proof of identity to the Secretary of State within seven days after the election.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.voteriders.org\/states\/north-carolina\/\" target=\"_blank\" rel=\"noopener\"><b>North Carolina<\/b><\/a><span style=\"font-weight: 400;\"> reinstated the state\u2019s photo ID law in May, which had been blocked by the courts in 2019 for being racially discriminatory. North Carolina voters will now be required to show photo ID beginning with upcoming municipal elections this fall.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.voteriders.org\/states\/ohio\/\" target=\"_blank\" rel=\"noopener\"><b>Ohio&#8217;s<\/b><\/a><span style=\"font-weight: 400;\"> new photo ID law is among the most onerous in the nation because it allows only four types of unexpired photo ID to vote.It\u2019s already in effect ahead of a crucial special election on August 8, 2023.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.voteriders.org\/states\/wyoming\/\" target=\"_blank\" rel=\"noopener\"><b>Wyoming<\/b><\/a><span style=\"font-weight: 400;\"> now requires first-time voters and voters who request an absentee ballot in person to present acceptable ID.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The 2021-2022 period also saw the rapid passage of voter ID laws, with new or stricter ID laws going into effect in nine states: Arkansas, Georgia, Florida, Iowa, Missouri, Oklahoma, South Carolina, Texas, and Utah. The 2022 midterm elections gave us a preview of how these <\/span><a href=\"https:\/\/www.voteriders.org\/three-lessons-from-the-midterms-about-voter-id-laws\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">new voter ID laws caused confusion and disenfranchisement across the country<\/span><\/a><span style=\"font-weight: 400;\">. Layering new ID laws from 2023 on top of these, it\u2019s likely that\u2013unless we act now\u2013this trend will continue in elections going forward, particularly in the 2024 presidential election with its expected high turnout.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As we head quickly into 2024, <\/span><a href=\"https:\/\/www.voteriders.org\/staterules\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">38 states now have voter ID laws in place<\/span><\/a><span style=\"font-weight: 400;\">. These new laws have not occurred in a vacuum, but rather against a backdrop of a wide array of increasingly restrictive voting laws which will make all aspects of casting a ballot and having it counted more difficult.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So what does all of this mean? For tens of millions of voters who go to cast a ballot in 2024, the voter ID rules in their state will have changed since 2020. <\/span><\/p>\n<blockquote><p><strong>It&#8217;s now harder, more confusing, and more expensive to exercise your freedom to vote due to the steadily-increasing number of new or stricter voter ID laws. For voters who do not have an acceptable ID for voting in their state, they must now expend time and, in many cases money, to acquire one of the accepted forms of identification. This burden will fall especially heavily on voters who do not have transportation to access an ID-issuing office, have a disability, or cannot afford ID fees.<\/strong><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Voters who <\/span><i><span style=\"font-weight: 400;\">do<\/span><\/i><span style=\"font-weight: 400;\"> have the specific form of ID needed in their states will still have to navigate the changes in their state\u2019s voter ID laws.
