{"id":14771,"date":"2023-04-14T18:10:19","date_gmt":"2023-04-14T18:10:19","guid":{"rendered":"https:\/\/www.voteriders.org\/?p=14771"},"modified":"2023-04-19T20:15:24","modified_gmt":"2023-04-19T20:15:24","slug":"voting-rights-returning-citizens-north-carolina","status":"publish","type":"post","link":"https:\/\/www.voteriders.org\/voting-rights-returning-citizens-north-carolina\/","title":{"rendered":"VoteRiders Pushes Back Against Barriers to the Ballot Affecting Over 56k Returning Citizens in North Carolina"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">By <\/span><a href=\"https:\/\/www.voteriders.org\/team\/sabrina-joy-mommers-jd\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Sabrina Mommers<\/span><\/a><span style=\"font-weight: 400;\">, VoteRiders North Carolina Organizer<\/span><\/p>\n<p><a href=\"https:\/\/www.voteriders.org\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">VoteRiders<\/span><\/a><span style=\"font-weight: 400;\"> encourages voter participation and helps Americans overcome barriers to the ballot by educating them about <\/span><a href=\"https:\/\/www.voteriders.org\/staterules\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">voter ID laws<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.voteriders.org\/freehelp\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">assisting those in need of an ID<\/span><\/a><span style=\"font-weight: 400;\"> to vote in communities across the nation.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As <\/span><a href=\"https:\/\/www.voteriders.org\/team\/sabrina-joy-mommers-jd\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">VoteRiders\u2019 North Carolina Organizer<\/span><\/a><span style=\"font-weight: 400;\">, my main responsibility is helping clients secure identification and obtain copies of other important identity documents like birth certificates and Social Security cards. I also always ask whether the client is registered to vote in North Carolina. A common response is,\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cOh, I cannot vote. I have a felony record.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In some states, <\/span><a href=\"https:\/\/forwardjustice.org\/campaign\/unlock-our-vote-campaign\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">people who have been convicted of a felony lose their right to vote <\/span><\/a><span style=\"font-weight: 400;\">during incarceration and their parole and periods of post-release supervision.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/www.ncsl.org\/elections-and-campaigns\/felon-voting-rights\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Other states also require returning citizens to pay fines and restitution<\/span><\/a><span style=\"font-weight: 400;\"> before they can register to vote. In <\/span><a href=\"https:\/\/www.washingtonpost.com\/business\/ex-felons-deserve-the-right-to-vote\/2023\/02\/24\/df549696-b441-11ed-94a0-512954d75716_story.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Virginia and Kentucky<\/span><\/a><span style=\"font-weight: 400;\">, those convicted of a felony can never exercise their freedom to vote.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Requiring returning citizens to pay fines and restitution before exercising their right to vote disproportionately impacts low-income citizens and people of color, as <\/span><a href=\"https:\/\/www.sentencingproject.org\/reports\/the-color-of-justice-racial-and-ethnic-disparity-in-state-prisons-the-sentencing-project\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Black Americans are incarcerated at disproportionately higher rates<\/span><\/a><span style=\"font-weight: 400;\"> than White Americans. <\/span><a href=\"https:\/\/sccinsight.com\/2020\/10\/12\/state-mandated-court-fines-are-sending-black-people-into-debt-and-to-jail-spd-is-making-the-problem-worse\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">A large percentage of America\u2019s Black population can never afford to fully pay off the steep fines<\/span><\/a><span style=\"font-weight: 400;\"> attached to their name after they re-enter society.\u00a0\u00a0<\/span><\/p>\n<figure id=\"attachment_14785\" aria-describedby=\"caption-attachment-14785\" style=\"width: 500px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-14785\" src=\"https:\/\/www.voteriders.org\/wp-content\/uploads\/2023\/04\/Sabrina-Shakeena.jpg\" alt=\"VoteRiders helps returning citizen\" width=\"500\" height=\"500\" \/><figcaption id=\"caption-attachment-14785\" class=\"wp-caption-text\">Sabrina Mommers helped returning citizen, Shakeena, obtain her birth certificate and driver&#8217;s license<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400;\">Regan Aduddell, a leader for the <\/span><a href=\"https:\/\/my.lwv.org\/north-carolina-state\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">League of Women Voters of North Carolina,<\/span><\/a><span style=\"font-weight: 400;\"> a <\/span><a href=\"https:\/\/www.voteriders.org\/partners\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">VoteRiders partner organization<\/span><\/a><span style=\"font-weight: 400;\">, said:\u00a0\u00a0<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">&#8220;<\/span><b>Why is it that we constantly tell people, \u2018You have fulfilled your sentence and now can re-integrate into your community <\/b><b><i>but<\/i><\/b><b>, we will not allow you a voice on how your community is run, a voice on issues that directly impact both the recently released and their family.\u2019 The system is not trusted, and they feel they have no voice and no real role in the community. We need to continue to work to both fight these voter suppression tactics while at the same time, making sure that we can reach out and educate this population on their rights, and supply them with all the tools \u2014 like IDs, current voter registrations, and election information.\u201c<\/b><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">A historic voting rights case has been working its way through the North Carolina courts since 2019. In December 2019, Forward Justice filed a lawsuit on behalf of four organizational plaintiffs and six individual plaintiffs in Wake County Superior Court, <\/span><a href=\"https:\/\/apnews.com\/article\/5747bb5667a418a1f7094dab8d2a3b54\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">seeking to reinstate voting rights for nearly 60,000 North Carolinians<\/span><\/a><span style=\"font-weight: 400;\"> previously convicted of felonies, and who had their right to vote taken away under the <\/span><a href=\"https:\/\/forwardjustice.org\/felony-disenfranchisement-history\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">felony disenfranchisement law.<\/span><\/a><\/p>\n<p><span style=\"font-weight: 400;\">In March 2022, North Carolina\u2019s lower courts determined that North Carolina citizens on probation, parole, or post-release supervision for felony convictions <\/span><a href=\"https:\/\/forwardjustice.org\/campaign\/unlock-our-vote-campaign\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">can exercise their right to register and vote<\/span><\/a><span style=\"font-weight: 400;\">. After North Carolina\u2019s 2022 Primary Elections, the Court of Appeals ordered the State Board of Elections (SBOE) to fully implement the trial court\u2019s <\/span><a href=\"https:\/\/forwardjustice.org\/wp-content\/uploads\/2022\/03\/2022.03.28-Final-Judgment-and-Order-19-CVS-15941.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">March 28th final judgment and order<\/span><\/a><span style=\"font-weight: 400;\">, which found that the state\u2019s existing felony disenfranchisement law is unconstitutional and ruled that all individuals living in the community with prior felony convictions must be allowed to register and vote.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This ruling has temporarily granted <\/span><a href=\"https:\/\/apnews.com\/article\/voting-rights-voting-race-and-ethnicity-racial-injustice-north-carolina-c4a6bea138d256a59f58efc5b144bd43\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">56,000 returning citizens the freedom to vote in North Carolina<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Now, the case is before the North Carolina Supreme Court, which heard oral arguments <\/span><a href=\"https:\/\/forwardjustice.org\/campaign\/unlock-our-vote-campaign\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">on<\/span> <span style=\"font-weight: 400;\">February 2nd, 2023.<\/span><\/a><\/p>\n<p><span style=\"font-weight: 400;\">At VoteRiders, our staff is dedicated to working with returning citizens to make sure they\u2019re informed of their voting rights. Without an ID, many North Carolina residents cannot secure employment, access life-saving medical care, or solidify a safe, permanent place to live.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With support from partner organizations, VoteRiders helps clients overcome economic, bureaucratic, and logical hurdles by providing ID information and assistance to underrepresented members of society who need an ID to apply for jobs, secure housing, access medical care, social security benefits, or vote for the first time. <\/span><a href=\"https:\/\/www.voteriders.org\/donate\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Donations from nationwide supporters<\/span><\/a><span style=\"font-weight: 400;\"> give VoteRiders the ability to offer our clients free copies of their birth certificates, identification, and driver\u2019s licenses, as well as<\/span><a href=\"https:\/\/www.voteriders.org\/freehelp\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\"> free transportation to the DMV<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">An ID is something so simple and yet so crucial to everyday life.
